Disposition of Water Rights

The Wyoming Legislature this year adopted House Bill 0002, which pertains to the disposition of water rights for new subdivisions within city jurisdictional boundaries. The requirements in the legislation will apply to all subdivision applications filed on or after July 1, 2022. The Sheridan City Council Monday night will be considering first reading of an ordinance that is intended to be a reference for developers and staff regarding HB0002. City Attorney Brendon Kerns.

According to the Wyoming Legislative Service Office, HB0002 is an act relating to the subdivision of land and water rights; requiring written documentation from the state engineer or state board of control on the disposition of water rights when subdividing land; requiring notice of the proposed disposition to other appropriators; making conforming amendments; providing applicability; and providing for an effective date.
