Swaneys Arraigned in District Court

In 4th Judicial District Court Tuesday morning, 38-year-old Clinton Swaney, represented by Sheridan attorney Mark Murphy; and his wife, 32-year-old Mandy Swaney, represented by Sheridan attorney Hardy Tate, were arraigned on one Felony Count of Obtaining a Prescription by Forgery – in this case, Percocet.

Court documents alleged that between December, 2009 and July of this year, the couple forged several prescriptions for the drug at multiple pharmacies, while Mr. Swaney was under the care of Doctors Strahan and Wilson.  Per a written plea agreement with the State, each agreed to plead Guilty and receive deferred adjudication so each can be put on supervised probation.  If they are successful with probation, the charge will be dropped.  Neither have prior felony convictions.

After each entered a Guilty plea, Judge John Fenn asked if they had anything to say.  Both indicated that they knew what they did was wrong.  Mr. Swaney explained that in September, 2003, while piloting a small plane in Alaska, the plane crashed, and he lost his left foot and broke his right foot.  He became addicted to the Percocet after that accident.  Several years later, Mrs. Swaney also started using the drug.

The two were instructed to report immediately to Probation and Parole after the hearing; sentencing is to be scheduled for early 2011.
