State Court Rules Death Row Inmate Got Fair Trial

CHEYENNE, Wyo. (AP) - A state district judge has ruled Wyoming's only death row inmate, Dale Wayne Eaton, received a fair trial before he received a death sentence in the 1988 rape and murder of a Montana woman.

Judge David B. Park of Casper released a written decision on Friday stating Eaton isn't entitled to any post-conviction relief.

The Wyoming Supreme Court has already upheld Eaton's death sentence for the rape and murder of 18-year-old Lisa Marie Kimmell, whose hometown was Billings, Mont. The U.S. Supreme Court has declined to review his case.

It's still possible that Eaton will ask the state supreme court to review Park's ruling. Eaton could also mount a federal appeal.
