New Water Tap Unused; Refund Requested

Sheridan Media News Director for Johnson County, Aaron Palmer, brings us this story from the Buffalo City Council.

A county resident has requested a refund for a water tap on his existing property, because it hasn't been installed. The request was made to the Buffalo City Council last week, through City Building Inspector Tom Hulick.

Hulick said the tap had been paid for before the work on Highway 16 East was started, but property owner Lynn Noteboom had decided not to hook up to City water, and was now requesting a refund of $5,300 for the cost of the tap.

No work has been done and the tap has not been installed, but the City Council said they needed to check the City's policy manual to see what they can and cannot do.

The question seems to be whether or not the City can refund the tap fee because too much time may have passed for the property owner to ask for a refund. Most of the council seemed to be in favor of refunding his money anyway. Council member Patty Reid said, “If no work has been done, how can we in good conscience keep his money?”

The City Council told Hulick to check the policy and bring the information back to them at their next meeting December 7th, when they will discuss the matter further.
