Gaffney Sentenced Under Plea Agreement

Jimmy Wayne Gaffney was sentenced on two charges while a third was dismissed Thursday in the court of District Judge John Fenn.

Gaffney initially pleaded not guilty to one count of possession of a controlled substance – marijuana – and two counts of delivery of a controlled substance.

But he changed his plea on Sept. 25 under an agreement with the state that the second count of delivery would be dropped and he would be sentenced only under the possession charge and one charge of delivery.

Fenn sentenced Gaffney to three to five years in prison on each of the two charges, then suspended both in favor of four years' supervised probation on each count. The two probationary periods will run concurrently.

The state had recommended that Gaffney also be sentenced to a split sentence of not more than nine months in prison, but Fenn omitted that.
