Commissioners Make Decision on Zowada Petition for Private Road

The Sheridan County Commissioners dealt with an issue Tuesday that dates back to 2006, as they made their ruling on a petition from Merlin and Lori Zowada to establish a private road to their business off of Fort Road. The Commissioners went with route 6, which they all agreed was a little more out of the way than route 1, but was much more reasonable for both parties involved in the matter.

Commissioner Steve Maier explains how much the private road to their business will end up costing Zowada.

Maier says that everyone has invested a lot of time and work into coming to this resolution.

The issue is one that began in 2006 when the Zowadas petitioned that a private road be established to access their business after they were notified by Mullinax Concrete that they could no longer use the road to their business that went through Mullinax property.

The Zowadas appealed the Commissioners decision several years ago and the Wyoming Supreme Court sent the issue back to the County because the Court felt that the Commission did not make adequate findings of fact, and did not compare the relative costs and benefits of the two options that were considered adequately.
