Buffalo Council Opts Not to Suspend Liquor License

At their last meeting the Buffalo City Council chose not to suspend a city retail liquor license on the recommendation of City Attorney Ben Kirven.

The Liquor license held by Don Seals Enterprises dba Ray's Liquor, has been flagged by the State Liquor Commission for non-payment of sales taxes by the retailer and has been subject to suspension of sales of alcohol to them by the commission.

Kirven explains further.

Kirven said Don Seals Enterprises, which includes Ray's Liquor, filed for Chapter 11 Bankruptcy in October of 2012, and when that happens, the court orders a “stay” against collections, which includes taxes. Kirven cautioned the council not to suspend the license on the grounds that it could violate the stay from the bankruptcy.

On the recommendation of City Attorney Kirven, the council took no action in the matter.
