Buffalo City Attorney Ben Kirven told the City Council at their meeting Tuesday he was prepared to send a letter he drafted to the Hartford, the bonding company for Hydro Construction, who built the city's wastewater treatment plant, asking them a second time to respond to the city's request for a review of issues at the city's wastewater treatment plant.

Kirven told the council he received a letter from the Hartford just minutes before the meeting.

The city and Hydro are at odds over defects and problems at the plant, including a tear in one of the liners in the sewage ponds. The parties disagree over who is ultimately esponsible for defects and problems at the plant, which prompted the city to contact Hydro Construction's bonding company for help in resolving the issue.
