A Pretrial Conference was held in 4th Judicial District Court Thursday for Montana resident Kevin Fuller, who is charged with kidnapping his girlfriend, Dawn Turner August, 7th 2009 in Sheridan. Prosecuting Attorney Matt Redle's motion for a continuance was reluctantly granted by Judge John Fenn, as the two day trial is now set to begin October 4th.
The continuance was requested by Redle because one of the prosecution's key witnesses in the case, Sheridan Police Sergeant Tom Henry would not be available to testify at the trial that was scheduled to begin August 11. Defense Attorney Ryan Healy's motion to reduce the $50,000 cash bond placed on Fuller was denied by Judge Fenn, who stated that another pretrial conference is likely, due to a number of evidentiary issues that were raised by the defense with a number of motions that were submitted just prior to the pretrial conference.
Also from District Court, Sheridan resident Tyler Feaster changed his plea to guilty on the charge of Sexual Abuse of a Minor. Terms of the plea agreement were a suspended sentence of 2 to 5 years in prison in favor of 10 years of supervised probation. On July 31, 2009, Feaster inappropriately touched an 11-year-old girl on the bottom in the game room of the Sheridan Wal-Mart.
Judge Fenn ordered a Presentence Investigation and set a sentencing date of October, 14th 2010.
