Justin Gerard, former Buffalo City Councilman, had his preliminary hearing Wednesday at the Campbell County Courthouse in Gillette. The state's case was found to have probable cause, and the case to be bound over to District Court for further proceedings.
Gerard was arrested after a traffic stop in Campbell County in April of this year on a charge of possession of a controlled substance with intent to distribute.
His initial preliminary hearings have all been postponed until Wednesday's proceedings.
Gerard took some heat from Buffalo residents, including some on the council itself in the weeks after his arrest and he finally resigned his seat on the council.
Gerard's case has not been scheduled yet in Campbell County District Court, but is expected to be in the next few days.
If convicted, Gerard could face up to $10,000 in fines, up to 10 years in prison, or both on the felony charge.
