The Johnson County Commission, acting as the County Board of Equalization, on Wednesday voted to reject a formal proposal from Sand Creek Ranch that could have resolved a more than 2 and a half year-old stalemate between the two entities on land tax assessments on the ranch property. Jenkins gave a presentation recapping the events over the last couple of years, and spoke specifically regarding County Assessor Dorothy Elsom, Deputy Assessor Mary Klaahsen and County Attorney Chris Wages and their perceived deeds and mistakes he and others with Sand Creek feel they have been harmed by.
Jenkins told the board, “We feel we have not received due process. We feel we have been discriminated against and we feel we have been seriously damaged.”
After his explanation of how those in Sand Creek were damaged, he told the board, “I'm not taking pleasure in any of this, but I feel you need to know the depth of our disappointment.”
The proposal Sand Creek gave the board included a waiver of all claims and litigation by Sand Creek; a dismissal of all actions on the part of the board, including their appeal to the State Board of Equalization; a set tax to be paid by those in Sand Creek; and a series of recitals to resolve damage (of character) issues for Sand Creek officials by the board.
After the board went into executive session to discuss the proposal, they returned and through counsel Dave Palmerlee said they had rejected the offer.
