The Buffalo City Council at their meeting Tuesday, denied a request from Justin and Bruce Beckner, developers of the Buffalo Ridge Subdivision, to reverse a decision made by the planning and zoning commission that denied a re-subdivision of his property.
Buffalo Ridge, LLC and their legal representation had filed a Notice of Appeal and approached the council, hoping to have the P&Z Commissions decision reversed, based on a conflict of interest and what they saw as a decision based on faulty information.
City Attorney Ben Kirven explained to the council his recommendation on the matter.
Attorney for Buffalo Ridge, David Horning, argued that sending the issue back to the planning commission would be unnecessary and would cause valuable construction time to be lost for his client.
His opinion was the council had the power to reverse the planning commission's decision and allow the process to move forward.
After discussions by the council, it was decided that the planning commission should readdress the issue and look at the entire request for re-subdivison again, and to have commission member Keith Neustel not participate in the discussions nor the vote on the matter.
