19-year-old Dylan Todd was sentenced in 4th Judicial District Court in Sheridan Thursday morning. He had been originally charged with Sexual Assault of a Minor in the 2nd Degree for an incident that had occurred in mid-December, 2010 involving a then-13-year-old girl. Todd was 17 at the time of the incident.
Scheduled to go to trial just before Christmas, 2011, Todd changed his plea last December to Guilty, per a plea agreement with the State. Terms of the plea agreement included a Guilty plea to a lesser charge of Sexual Assault of a Minor in the 3rd Degree with a deferred sentence and probation of 1 to 5 years. The plea agreement also stated that Todd be charged with an additional count of misdemeanor Sexual Battery, to which he plead No Contest in Circuit Court.
During sentencing Thursday, Judge John Fenn rejected the plea agreement on a minor matter and modified it: he accepted the plea for Misdemeanor Sexual Battery, sentencing Todd to 90 days, suspended; however, Todd is to serve seven days in the Sheridan County Detention Center during the University of Wyoming's upcoming Spring Break.
Regarding the Felony Sexual Assault of a Minor in the 3rd Degree, Todd was sentenced to 1 to 5 years probation, with at least one year to be supervised. On the Misdemeanor charge, along with the jail term, Todd was placed on one year supervised probation, which will run concurrently to the Felony probation.
Todd is also to pay $200 to the Crime Victims' Compensation Fund on the Felony charge and $150 to the CVCF on the Misdemeanor charge, along with $20 for miscellaneous court costs and $75 for the Substance Abuse Evaluation done during the Pre-Sentence Investigation. He is also to seek mental health treatment and is not to have any contact with the victim or her family.
Judge Fenn admonished Todd, saying, "You have such potential, and so much at stake! If your probation is revoked, you will be required to register as a sex offender and could face prison time. And believe me, prison is particularity not a nice place for a 20-year-old sex offender."
