Sheridan resident Eddie Delk changed his plea in 4th Judicial District Court Wednesday. Sheridan Media's Ron Richter was there and has the details.
Delk plead “No Contest” to Felony Aggravated Assault and Battery. On the evening of March 19th of this year, Delk shot Kenny Rosalez with a .357 Magnum handgun after an altercation at the home of Roger and Dixie Bettcher, who are the parents of Stacie Rosalez, Kenny's ex-wife. Delk and Stacie Rosalez had been living together, however, Delk was in the process of moving out.
During the change of plea hearing, Prosecuting Attorney Matt Redle explained that if this case had gone to trial, he would have produced several witnesses who would have testified that during the scuffle between Delk and Rosalez, Delk went across the street to his vehicle where he retrieved the handgun that he used to shoot Rosalez.
Terms of the plea agreement reached with the State are a prison sentence of 2 to 4 years and to pay any and all restitution. 4th Judicial District Court Judge John Fenn reminded Delk that the Court is by no means bound by the terms of the plea agreement and
ordered a pre-sentence investigation to be conducted prior to the sentencing date of January 26th, 2012.
