Zackery Morrison Sentencing Delayed

In Sheridan County District Court Tuesday morning, 19-year-old Zackery Morrison went before Judge John Fenn to receive sentencing on a 3rd Degree sexual abuse of a minor conviction. The court had ordered Morrison to undergo a psycho-sexual evaluation, which he has not yet had because of confusion over who is going to foot the bill for counseling services. Morrison is considered indigent, and therefore does not have money to pay; the County will not pay for it, and the counselor informed Morrison's attorney, Robert Jones, that she will not see him if she's not paid.

Judge Fenn determined that he could not sentence Morrison without the evaluation, and continued the matter until the situation could be straightened out. Meantime, Fenn indicated that Morrison has not been an exemplary inmate in the Sheridan County Detention Center, with behavior that has "earned" him isolation. Fenn added that if Morrison could not behave well in jail, how could he be expected to succeed under supervised probation, which could be factored into his sentencing.

Morrison was found guilty for events that occurred on September 26th, 2009 when he unlawfully engaged in sexual contact with a victim who was between the ages of 13 and 15. Sexual Abuse of a Minor in the 3rd Degree is a felony punishable by imprisonment for not more than 15 years, a fine of not more than $10,000, or both.

Unfair Justice System

If he was found guilty why is there a need for an evaluation. If this was someone that was dealing drugs or had killed someone there would be no need for an evaluation prior to sentencing. Why protect sex offenders? I think that is the most horrible crimes someone could commit. An innocent 13 to 15 yr old girl was involved in this case and will forever be haunted by what this criminal has done to her.
