LDCC Hears Update From Work Group On Shoreline Issues

At their May meeting held in Buffalo last week, the Lake DeSmet Counties Coalition Joint Powers Board was updated on the latest negotiations on shoreline easements with both private and public users and landowners at the lake.

The Shoreline Work Group reported that public use portion of the proposed regulations are proceeding alright, but the private discussions have stalled and they believe it will take legal counsel to resolve the differences.

David Garber, Chair of the LDCC JPB, asked the group and the easement holders present if there could be a resolution without legal proceedings.

LDCC Lawyer Kim Cannon addressed the JPB, saying court action should not be entered lightly, saying two parties cannot go before a judge asking for a decision unless the parties are seeking a firm declaratory judgement.

The decision of the JPB was to have Cannon try to resolve the issues with the easement holders and their legal counsel one last time before entering into litigation.

He will report back the the JPB at their July meeting.
