Sheridan Media reported last week that the Johnson County Commissioners had approved paying the legal fees incurred by County Assessor Cindy Rogers in connection with the proposed lease of water rights by the Wyoming Game and Fish and the possible tax ramifications that could have possibly stemmed from allowing the lease.
Johnson County Attorney Ken DeCock issued a media release Monday afternoon addressing the commissioner's vote to pay the invoice.
DeCock said the decision is contrary to his advice as legal counsel for the county. DeCock also said the State Attorney General's opinion is that no specific statute gives the assessor express authority to hire outside legal counsel, and that doing so was beyond the authority of her office.
DeCock advised the commissioners and the County Clerk to not pay the invoice for Rogers' legal counsel, adding that she had said she would pay the fees herself, which is the correct thing to do under the circumstances.
