The jury deliberated for nearly 2 hours before delivering a guilty verdict against 20-year-old Kyle Anton of Gillette on both counts in his burglary trial on Thursday afternoon. Anton was convicted of breaking into the City Brew coffee store on North Main Street and stealing nearly $750, with 19-year-old Cody Ellenson in December of 2008.
The day started with a short cross examination of the final state’s witness. The prosecution rested their case after that witness finished testifying. Then, in a move that surprised even presiding Judge John Fenn, the defense rested without putting on a case.
Closing arguments by the defense asked the jury to disregard testimony delivered by Ellenson against Anton. Ellenson previously pled guilty to the same burglary charges in a plea agreement with prosecutors. Ellenson has already been sentenced to 3 to 4 years in prison.
Anton’s bond was continued pending sentencing. A pre-sentence investigation has been ordered. Anton could receive up to 10 years in prison on both the burglary and attempted burglary convictions.
