18-Year-Old Sheridan Man Changes Plea on Sexual Assault Charge

18-year-old Dylan Todd of Sheridan changed his plea Thursday in 4th Judicial District Court. Todd was originally charged with Sexual Assault in the 2nd Degree for incident involving a 13-year-old girl at a party in December of 2010. At the time of the alleged crime, Todd was 17 years of age. Terms of the plea agreement with the State include Todd pleading “Guilty” to the lesser charge of Sexual Assault in the 3rd Degree with a deferred sentence and probation of 1 to 5 years. The plea agreement also states that Todd will be charged with an additional count of misdemeanor Sexual Battery and will most likely plead guilty or no contest when he appears in Circuit Court on that charge.

On the misdemeanor Sexual Battery Charge, the plea agreement recommends up to one year of probation and a 90 day jail sentence to be suspended. District Court Judge John Fenn reminded Todd that the Court by no means is bound by the terms of the plea agreement and if the Court chooses to reject it at sentencing, Todd could face up to 15 years in prison and a fine of up to $10,000 and would be required to register as a convicted sex offender.

Judge Fenn ordered that a pre-sentence investigation be conducted but set no sentencing date at the hearing. He did indicate that with the full schedule of the Court, it would probably be mid February when Todd is sentenced.
